Terms of Service

These Terms govern your use of the app and web service "MACS Nihongo" (the "Service") provided by CDC Co., Ltd. (株式会社シーディーシー) ("we", "us"). By using the Service you agree to these Terms.

1. The Service

The Service provides study features including creating word lists, typing quizzes, flashcards, Japanese pronunciation audio, and extracting words from photos. No account registration is required.

2. Free use

Creating word lists, quizzes, flashcards and audio are free. On the free plan, "extracting words from photos" is limited to a certain number of times per month. We set that number and display it inside the Service, and we may change it as needed for the operation of the Service.

3. Premium

3.1 What it includes and what it costs

With Premium, the monthly limit on photo extraction is removed. The price is US$0.99 per month. A daily cap remains in place to keep the service stable.

3.2 Term and automatic renewal

Your subscription renews automatically every month from the day you subscribe, and you are charged on each renewal date.

3.3 Cancellation

You may cancel at any time from the "Premium" screen in the Service. After cancelling, you keep Premium features until the end of the period you have already paid for.

3.4 Refunds

Because this is digital content, we do not provide refunds after payment, and we do not pro-rate. Cancelling before your next renewal date prevents any further charges.

3.5 Payment

Payment is by credit card only, processed by Stripe. Card details are handled by the payment processor; we do not collect or store them.

3.6 Where to subscribe

Subscribing and cancelling are done on the web version (https://macs-nihongo-en.pages.dev). You cannot subscribe from inside the iOS or Android app.

4. Minors

If you are under 18, you must obtain your parent's or guardian's consent before subscribing. If a minor subscribes without such consent, we may terminate the subscription.

5. Prohibited conduct

Acting unlawfully or contrary to public order and morals
Interfering with the operation of the Service or placing excessive load on our servers
Circumventing usage limits by improper means
Infringing third-party rights, for example by importing large amounts of copyrighted material without permission
Copying, modifying or redistributing the Service, or providing it to third parties for profit
Distributing or publishing an access phrase or any other unlocking method without our permission

6. Your data

User information is handled as described in our Privacy Policy.

Word lists and study records are stored on your device. Data can be lost if your device breaks, is lost or reset, if you delete the app, or if you clear your browser data. Please back up anything important yourself using the export feature. We are not liable for lost data.

7. Changes, interruption and termination

We may change or suspend the Service without prior notice. If we discontinue the Service we will give advance notice where reasonably possible. If we discontinue Premium for our own reasons, we will refund the amount corresponding to the unused period.

8. Disclaimers

Photo extraction is automated AI processing and we do not guarantee that the results are accurate. Please check the results yourself.
We do not guarantee any particular learning outcome or examination result.
We are not liable for disadvantages arising from your network conditions, failures of external services, or problems with your device.
Except in cases of our wilful misconduct or gross negligence, our total liability to you is limited to the total amount you paid us in the preceding 12 months.

9. Changes to these Terms

We may amend these Terms. Amended Terms take effect when posted on this page. We will announce changes to pricing and other material terms inside the Service in advance.

10. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Osaka District Court shall have exclusive jurisdiction of the first instance over any dispute relating to the Service.
